Terms of Use

Welcome to MyHandle ("Platform", "we", "our", or "us"). These Terms of Use ("Terms") govern your access to and use of myhandle.at, the YouCast365 broadcasting network, and any associated services, features, or APIs (collectively, the "Services").

By creating an account, claiming a handle, purchasing credits, or registering audio files, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services.

1. Description of Services

MyHandle operates as an AI-native music registry, a B2B Sync Licensing Marketplace, and a performance royalty collection entity via the YouCast365 broadcasting network. We provide immutable digital timestamping via acoustic fingerprinting (AI-ID) and act as a commercial licensing agent for our users.

2. Intellectual Property, AI Generation, & Authorship

MyHandle acknowledges current United States Copyright Office (USCO) guidelines regarding generative AI. You understand and agree to the following registration tiers:

• Pure AI Registrations: If you register a track generated 100% by artificial intelligence, you acknowledge that no federal copyright claim is being made. MyHandle will generate an AI-ID for tracking and issue platform-specific Sync Licenses, but does not guarantee external legal copyright enforcement.
• Hybrid Registrations (The Human Element): If you register a track under the "Hybrid" tier, you expressly legally warrant and represent that you are the sole human author of the underlying written lyrics, AND/OR you are the exclusive owner or authorized licensee of the vocal identity (Right of Publicity) used to generate the track. You grant MyHandle the right to issue commercial licenses based strictly on these human-owned elements.

3. Purchasing & Using Platform Credits

To register tracks and utilize premium features, users must purchase Platform Credits.

• Value: 1 Credit is equivalent to $1.00 USD.
• Non-Refundable: All purchases of Credits are final. Credits are strictly non-refundable under any circumstances, including account termination or suspension.
• No Expiration: Credits do not expire. Any unused Credits will automatically carry over from month to month indefinitely as long as your account remains active.
• No Cash Value: Credits are a digital utility token for use exclusively within the MyHandle ecosystem and cannot be redeemed, cashed out, or transferred to other users for fiat currency.

4. Earnings, Payouts, and Taxes

If your registered tracks generate revenue via Sync License sales or YouCast365 radio royalties:

• Platform Fees: MyHandle retains a twenty percent (20%) administrative fee on all Sync Licenses sold through the marketplace. The remaining 80% is credited to your dashboard ledger.
• Payout Requirements: To withdraw earnings, you must provide a valid PayPal address or ACH banking information, and complete our Tax & Legal Information form (W-9 equivalent).
• Taxes: You are solely responsible for reporting and paying all applicable local, state, and federal taxes on your earnings. MyHandle will issue a 1099 tax form for distributions exceeding $600.00 USD in a calendar year.

5. Limitation of Liability

To the maximum extent permitted by law, in no event shall MyHandle, YouCast365, or their founders, directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (A) your access to or use of or inability to access or use the services; (B) any copyright infringement claims brought against you by third parties; or (C) any unauthorized access, use, or alteration of your transmissions or content.

6. Indemnification

You agree to defend, indemnify, and hold harmless MyHandle, YouCast365, and their founders, officers, and employees from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your registered Hybrid tracks infringe upon the intellectual property or Right of Publicity of a third party.

7. Termination

We reserve the right to suspend or terminate your account, Handle, and access to the Services at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms, upload fraudulent tracks, or falsify human authorship claims.
